1 Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and DigiCoFunnel ("Company," "we," "us," or "our"), the operator of ContentForgeAI.

By clicking "Purchase," "Get Access," or otherwise using any part of the ContentForgeAI platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2 Description of Service

ContentForgeAI is an AI-powered social media content generation tool that enables users to:

• Input product name, description, and optional URL
• Select a business niche and target social media platform
• Generate ready-to-publish social media post content
• Access features including Product Intelligence AI, URL scraping, 30/60/90 Day Strategy, content calendar, performance tracking, and export functionality

The service is provided on a software-as-a-service (SaaS) basis via web browser access. Features may vary by plan type (Early Bird vs. Lifetime).

3 Eligibility

To use ContentForgeAI, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be prohibited from receiving or using our service under applicable laws
• Provide accurate and complete information when purchasing

By using ContentForgeAI, you represent and warrant that you meet all of the above eligibility requirements. Use of the platform by anyone under 18 is strictly prohibited.

4 Account & Access

Upon completing your purchase, you will receive access credentials to ContentForgeAI. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Promptly notifying us of any unauthorized use of your account at Support@digicofunnel.com

You may not share, sell, or transfer your account access to any third party. Each purchase grants access to a single user account unless otherwise specified.

5 License Grant & Restrictions

Subject to your compliance with these Terms and payment of applicable fees, DigiCoFunnel grants you a limited, non-exclusive, non-transferable, revocable license to access and use ContentForgeAI for your personal or commercial business purposes.

You may NOT:

• Resell, sublicense, or redistribute access to ContentForgeAI as a standalone product
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Create competing products or services based on ContentForgeAI's functionality
• Use automated tools, bots, or scrapers to access or extract data from the platform
• Remove or alter any proprietary notices, branding, or labels on the platform
• Use the service to offer a content generation service to clients as a white-label product without written permission from DigiCoFunnel

6 Acceptable Use Policy

You agree to use ContentForgeAI only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. You must not use ContentForgeAI to:

• Generate content that is defamatory, harassing, threatening, abusive, or discriminatory
• Create or distribute spam, unsolicited bulk messaging, or misleading commercial communications
• Produce content that infringes on any third party's intellectual property, trademark, or copyright
• Generate false, misleading, or fraudulent advertising or promotional claims
• Create content promoting illegal activities, violence, or self-harm
• Attempt to circumvent any security feature, access control, or usage limit of the platform
• Collect or harvest personal data from other users of the platform

7 Content Ownership & Responsibility

Your Input: You retain all rights to the product information, descriptions, and data you enter into ContentForgeAI.

Generated Output: Content generated by ContentForgeAI using your input is provided for your use. You are free to use, modify, publish, and distribute generated content for any lawful commercial or personal purpose.

Your Responsibility: You are solely responsible for reviewing all generated content before publishing to ensure it:

• Accurately represents your product or service
• Complies with each social media platform's terms of service and community guidelines
• Complies with applicable advertising laws and regulations (including FTC disclosure requirements)
• Does not infringe on any third party's rights

DigiCoFunnel is not responsible for any consequences arising from your publication or use of AI-generated content.

8 Payment & Pricing

ContentForgeAI is offered under the following pricing plans (in USD):

• Early Bird / Founders Special: $14 one-time payment (limited to first 100 users)
• Lifetime Plan: $22 one-time payment

All prices are in US Dollars (USD). Payment is processed securely by our third-party payment processor. By completing a purchase, you authorize us to charge the stated amount to your chosen payment method.

We reserve the right to change pricing at any time. Price changes will not affect purchases already completed.

9 Refunds

10 Intellectual Property

ContentForgeAI, the DigiCoFunnel brand, all underlying software, design, algorithms, features, and associated documentation are the exclusive intellectual property of DigiCoFunnel and are protected by applicable copyright, trademark, and other intellectual property laws.

Nothing in these Terms transfers any intellectual property rights to you. Your license to use ContentForgeAI does not include any right to the underlying technology, source code, or platform infrastructure.

11 Disclaimers & No Guarantees

We do not warrant that:

• The service will be uninterrupted, error-free, or completely secure
• Generated content will achieve any specific business results, engagement rates, conversions, or revenue
• The platform will meet every specific requirement or expectation
• Any errors or defects will be corrected within a specific timeframe

No Results Guarantee: Results from using ContentForgeAI will vary based on individual circumstances, effort, market conditions, and many other factors outside our control. See our Results Disclaimer for complete details.

We disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

12 Limitation of Liability

To the maximum extent permitted by applicable law, DigiCoFunnel and its officers, directors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from your reliance on AI-generated content
• Any business decisions made based on the platform's output

In all cases, DigiCoFunnel's total cumulative liability to you for any claims arising from or related to your use of ContentForgeAI shall not exceed the total amount you paid for the service in the 12 months preceding the claim.

13 Indemnification

You agree to indemnify, defend, and hold harmless DigiCoFunnel, its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use or misuse of ContentForgeAI
• Your violation of these Terms
• Content you generate and publish using our platform
• Your violation of any third-party rights or applicable laws

14 Service Availability & Changes

We strive to maintain high availability of ContentForgeAI but do not guarantee uninterrupted access. We reserve the right to:

• Perform scheduled or emergency maintenance that may temporarily affect access
• Modify, update, or discontinue any feature with reasonable notice
• Update or change the platform's AI models and content generation capabilities
• Adjust usage limits or platform infrastructure as needed

We will provide reasonable advance notice of significant changes or planned downtime where possible.

15 Termination

We reserve the right to suspend or terminate your access to ContentForgeAI immediately and without notice if:

• You violate any provision of these Terms
• You engage in fraudulent activity, including chargeback abuse
• Your use of the platform creates legal or reputational risk for DigiCoFunnel
• Required by law or legal process

You may cancel your account at any time by contacting Support@digicofunnel.com. Termination for cause will not entitle you to a refund outside the 30-day guarantee window.

16 Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or your use of ContentForgeAI shall be resolved as follows:

• First: Both parties agree to attempt resolution through good-faith negotiation. Contact us at Support@digicofunnel.com.
• Second: If negotiation fails within 30 days, disputes may be submitted to binding arbitration.
• Class Action Waiver: You agree to resolve disputes individually, not as part of a class action or representative proceeding.

17 Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify registered users by email. Your continued use of ContentForgeAI after such notification constitutes your acceptance of the revised Terms.
